The department filed a notice Dec. 10 with the U.S. District Court, arguing that the complaint essentially involves a child custody matter and that the federal court lacks jurisdiction over domestic disputes.
“It is well settled that federal courts should abstain from adjudicating domestic relations cases, including those involving the custody of children,” attorneys for Sheriff Leroy D. Baca said in the notice.
The defendants will formally make a motion for dismissal Jan. 5.
